O Departamento Nacional de Infraestrutura de Transportes (Dnit) terá que pagar indenização por danos materiais para uma transportadora catarinense que teve a carga danificada em acidente ocorrido na BR-226 devido às más condições da rodovia. A 3ª Turma do Tribunal Regional Federal da 4ª Região (TRF4) negou, na última semana, recurso do órgão.
O acidente aconteceu em maio de 2013. O caminhão trafegava no Km 404, no município de Grajaú (MA), quando ao tentar desviar de um buraco na pista tombou, perdendo a carga de arroz, que foi saqueada por moradores locais.
A Data Mecânica ajuizou ação na 4ª Vara Federal de Criciúma (SC) contra o Dnit alegando que as péssimas condições da estrada teriam ocasionado o acidente e pedindo indenização por danos materiais. A ação foi julgada procedente, condenando o órgão ao pagamento de R$ 72.775,00.
O Dnit recorreu atribuindo a culpa pelo acidente ao motorista, que estaria dirigindo sem cautela. O órgão alegou também que os recibos levados aos autos pela empresa não discriminam o quanto foi gasto na manutenção do veiculo, mas apenas o que foi perdido em carga.
Para o desembargador federal Fernando Quadros da Silva, relator do caso, “é comprovado que o buraco na rodovia foi a causa direta e imediata para a ocorrência do acidente”. Segundo o desembargador, ficou configurada a responsabilidade do réu sobre a perda da carga, devendo ressarcir a autora.
Quanto aos danos no caminhão, o magistrado ressaltou que “cabe à parte autora demonstrar documentalmente o valor do dano material sofrido pelo conserto do veículo, bem como os lucros cessantes, não bastando para isso orçamentos sem data ou de oito meses após o acidente”, concluiu.
