Sob o entendimento de que houve fraude ao credor, o Tribunal Regional Federal da 4ª Região (TRF4) confirmou, na última semana, a ineficácia da doação de seis imóveis situados em Itaqui (RS) realizada por um devedor. Segundo a decisão da 4ª Turma, o proprietário tinha uma dívida rural de R$ 4 milhões e teria tentado blindar o patrimônio passando os imóveis para o nome dos cinco filhos.
A ação foi movida pela União/Fazenda Nacional em setembro de 2013. Em novembro de 2014, a 2ª Vara Federal de Uruguaiana proferiu sentença reconhecendo a ineficácia das transações imobiliárias perante a União.
O produtor rural recorreu alegando que a doação com reserva de usufruto teria sido feita de boa-fé e que não haveria impedimento legal para a transferência. Ele argumenta que os imóveis são impenhoráveis, pois além de servirem de sustento à família, são enquadrados como pequena propriedade rural. Pediu a reforma da sentença.
Segundo o relator do processo, juiz federal Loraci Flores de Lima, convocado para atuar no tribunal, não ficou comprovado nos autos que o imóvel rural é explorado diretamente pelo réu e por sua família, situação exigida para caracterizar a impenhorabilidade.
“Caracteriza-se fraude contra credores o negócio jurídico de transmissão gratuita de bens realizado por devedor insolvente, ou seja, a situação em que o devedor se desfaz do seu patrimônio, suprimindo completamente a garantia do cumprimento de sua obrigação de pagar”, concluiu o magistrado.
