A 45ª Vara Cível Central da Capital determinou a suspensão e apreensão do passaporte e da Carteira Nacional de Habilitação (CNH) de uma mulher devedora que, apesar de decisão judicial proferida em 2014, continua inadimplente. A ré também deverá informar quais são e onde estão os seus bens sujeitos à penhora e os respectivos valores.
Consta nos autos que a ré havia feito contrato de franquia de uma empresa odontológica e não pagou os royalties e as taxas de propagandas. O juiz Guilherme Ferreira da Cruz, da 45ª Vara Cível Central, afirmou em sua decisão ser “razoável que ela - antes de solver a dívida aqui disputada - não mais viaje ao exterior e fique sem dirigir veículos automotores; aliás, que não tem”. Por outro lado, o magistrado julgou desnecessário restringir os cartões de débito e crédito da devedora.
“Tais medidas, proporcionais, não violam e/ou mitigam a dignidade da pessoa humana e podem - e devem - ser aplicadas na forma do art. 139, IV, do Código de Processo Civil, pena de se desmoralizar o cumprimento de ordem judicial impositiva de prestação pecuniária”, continuou o magistrado.
Cabe recurso da decisão.
